Hilppus Terms of Service

These Terms of Service (the "Terms") are a legally binding agreement between you and Hilppus Team ("Hilppus", "we", "us", or "our") governing your use of the Hilppus mobile application and related services (collectively, the "Service").

1) Eligibility (Age 17+)

The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old.

2) The Service

Hilppus is a community for video-based fitness inspiration and motivation. You can record and upload fitness videos, discover techniques, engage with others through comments and encouragement, and receive personalized recommendations.

3) Your Account

• Accurate info: provide and maintain accurate name/username/email.
• Security: keep credentials confidential and notify us of unauthorized use.
• Termination: you can stop using the Service at any time; we may suspend/terminate access for violations or safety/legal reasons.

4) User Content and Community Rules

"User Content" includes videos, images, captions, comments, and other materials you submit or upload.

4.1 License You Grant Us

You retain ownership of your User Content. To operate the Service, you grant Hilppus a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, distribute, publicly display, publicly perform, and create derivative works of your User Content solely for operating, providing, and improving the Service, showing content to others as you choose, and enforcing these Terms and safety.

This license ends when you delete your User Content or your account, except where retention is required for legal compliance, dispute resolution, enforcement, or where content has been shared with others and they have not deleted it.

4.2 Prohibited Content and Conduct

• Illegal, harmful, or fraudulent content.
• Hate, harassment, threats, sexual exploitation, or violence-promoting content.
• IP, privacy, or other rights violations.
• Viruses, hacking, unauthorized access, scraping, reverse engineering, or security circumvention (except as permitted by law).
• Impersonation or misrepresentation.

4.3 Moderation

We may remove or restrict content and accounts at our discretion for safety, policy, or legal reasons. We are not obligated to monitor all content.

5) AI-Assisted Features (Optional)

Some features may offer optional AI-assisted processing (for example, generating content based on user-provided text or images, or enhancing/transforming user-provided media). You are responsible for reviewing outputs before sharing or relying on them.

Outputs may be inaccurate or inappropriate and are not professional advice (including medical or fitness advice).

The Service (including software, designs, trademarks, and content provided by Hilppus) is owned by Hilppus or its licensors and is protected by law. You may not use our trademarks or copyrighted materials without permission, except as allowed by law.

8) Third-Party Services

We are not responsible for third-party services. Your use of them may be governed by their terms and policies.

9) App Store Terms (Apple)

• These Terms are between you and Hilppus, not Apple.
• Apple has no obligation to provide maintenance or support.
• If the Service fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); Apple has no other warranty obligation to the maximum extent permitted by law.
• Apple is not responsible for addressing claims relating to the Service, including product liability, regulatory compliance, or consumer protection claims.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

Our Privacy Policy explains how we collect and use information. By using the Service, you agree to those data practices.

11) Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, Hilppus disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the maximum extent permitted by law, Hilppus will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service.

To the maximum extent permitted by law, Hilppus's total liability for any claim will not exceed the greater of (a) the amount you paid to Hilppus for the Service in the 12 months before the event giving rise to the claim, or (b) USD $100.

13) Indemnity

You agree to indemnify and hold harmless Hilppus from claims arising from your use, your content, or your violation of these Terms.

14) Governing Law

These Terms are governed by the laws of Hilppus Team's primary place of business, excluding conflict-of-laws rules.

15) Binding Arbitration and Dispute Resolution

• Informal first: contact us at tupzwnbceo5746@outlook.com with a description of the dispute.
• Binding arbitration: if unresolved, disputes will be resolved by binding arbitration administered by a reputable provider under its rules, except where prohibited by law.
• No class actions: disputes will be conducted on an individual basis to the maximum extent permitted by law.
• IP / security exceptions: either party may seek injunctive relief for IP misuse/infringement or unauthorized access where permitted by law.

16) Changes to These Terms

We may update these Terms from time to time by updating the Effective Date above and providing notice where required. Continued use means acceptance.

17) Miscellaneous

If any provision is unenforceable, the rest remains in effect. These Terms are the entire agreement between you and Hilppus regarding the Service.
